All services may be used for lawful purposes
only. Transmission, storage, or presentation of any information,
data or material in violation of any International Law is prohibited.
This includes, but is not limited to: copyrighted material, material
we judge to be threatening or obscene, or material protected by
trade secret and other statute. The subscriber agrees to indemnify
and hold us harmless from any claims resulting from the use of the
service which damages the subscriber or any other party.
Note: Pornography and sex-related merchandising
are prohibited on all servers.This includes sites that contain nudity
or may infer sexual content, or link to adult content elsewhere.
This is also true for sites that promote any illegal activity or
content that may be damaging to our servers or any other server
on the internet. Links to such materials are also prohibited.
In addition any site selling or promoting Bulk
Email Services is not allowed.
Examples of non-acceptable content or links:
Pirated software
Hackers programs or archives
Warez Sites
Irc Bots
We will be the sole arbiter as to what constitutes a violation of
this provision.
Response Time to Critical Support Requests
Critical Support Requests are handled as quickly
as possible, with response times ranging from 15 minutes to 3 hours.
Response Time to Non-Critical Support Requests
Non-critical support requests are handled on a
case-by-case basis, with a response time from within 1 hour to within
2 business days.
Contract Term
Contract is month to month and will renew automatically,
unless termination of service notice is received at least 10 days
prior to end of month.
Service Rates
Subscriber acknowledges that the nature of the
service furnished and the initial rates and charges have been communicated
to Subscriber. Subscriber is aware that the Company may prospectively
change the specified rates and charges from time to time. Any promotional
offer received reamins at it's price for the extent of the promotion.
Payment
Establishment of this service is dependent upon
receipt by the Company of payment of stated charges. An email may
be sent to the subscriber 10 says before the billing date when available.
Payments and Fees
Service will be interrupted on accounts that are
at least 10 days past due. Accounts not paid by due date are subject
to a $10 reactivation fee.
Failure to Pay
The Company may temporarily deny service or terminate
this Agreement upon the failure of Subscriber to pay charges when
due. Such termination or denial will not relieve Subscriber of responsibility
for the payment of all accrued charges, plus reasonable interest
and any collection fees.
Account Cancelation
All requests for canceling accounts must be made
in writing/email with at least 30 days notice but not more than
60 days prior written notice. You must have all account information
to cancel. Cancelations will be effective after 30 days and the
time left in the pay period.
Service Interruptions
Subscriber acknowledges that the service provided
is of such a nature that service can be interrupted for many reasons
other than the negligence of the company and that damages resulting
from any interruption of service are difficult to ascertain. Therefore,
subscriber agrees that the company shall not be liable for any damages
arising from such causes beyond the direct and exclusive control
of the company. Subscriber further acknowledges that the company's
liability for its own negligence may not in any event exceed an
amount equivalent to charges payable by subscriber for services
during the period damages occurred. In no event shall the company
be liable for any special or consequential damages, loss or injury.
The Company is not liable for data loss and corruption.
Traffic Guidelines
All accounts are limited to a particular 'Bandwidth'
limit (as noted in the plan information); Should a site use more
than it's provided bandwidth the site is automatically suspended
until the matter is resolved. In these issues you may purchase more
bandwidth at a price of $2USD/500MB Bandwidth. If you do not wish
to purchase more bandwidth you can 'wait out' the remaining days
of your month until your limit is reset to the full amount in your
next billing month.
CGI-Scripts
You are free to use any CGI scripts you wish,
however, we reserve the right to disable any CGI script that effects
normal server operation.
Chat Rooms
We do allow clients to install their own chat
rooms. These tend to be large system hogs and we do allow it as
an account option. We do provide a choice of Java chat rooms that
will more than fill your needs and run without hindering the performance
of the machine for others. You are limited to one chat room on your
domain.
Background Running Programs
We do allow programs to run continually in the
background. These are considered on a one to one basis and an extra
charge will be incurred based on system resources used and operational
maintenance needed.
IRC
We currently do not allow IRC Servers or IRC bots
to be operated on our servers. Personal IRC chat rooms on your web
site are allowed provided they do not use so much resources that
they inter fear with other users on the server.
E-MAIL Spamming
Our servers may not be the source, intermediary,
or destination address involved in the transmission of spam, flames,
or mail bombs. Your domain may not be referenced as originator,
intermediary, or reply-to address in any of the above. Advertising
sites on other servers which in turn contain links to a domain on
our servers is prohibited. We consider spam any mass unsolicited
message in the mediums of Newsgroups and Email. If you are found
to have spammed, then we will immediately, without warning, disable
your domain. Lastly, we reserve the right to determine what violates
this policy.
As such, any violation will result in immediate
deactivation of services without refund.
Server Abuse
Any attempts to undermine or cause harm to a server
is strictly prohibited.
Refusal Of Service
We reserve the right to refuse or cancel service
at our sole discretion. Failure to comply with with any of our policies
will result in immediate termination of services. No refunds will
be issued under these circumstances.
Refund Policy
If a customer not satisfied with our services
we will provide a full refund for the month that our service was
considered unsatisfactory. Should a customer purchase a annual,
bi-annual or quarterly contract term and is unsatisfied during the
first month we will provide a full refund for the entire contract
length, provided the refund request was made during the first month.
Requests made after the first month we will refund the month of
the complaint and any months left on the contract. *Please note
that there are no refunds for labor based services such as design
services.
